Terms of Service
Last updated: [LAST UPDATED DATE]
These Terms of Service ("Terms") are a legally binding agreement between you ("you", "User", "Household" or "Employer") and [LEGAL ENTITY NAME] ("househelp", "we", "us" or "our"), registered in India ([CIN/REGISTRATION NUMBER]) with its registered office at [REGISTERED ADDRESS], which operates the website [WEBSITE URL] and related services (together, the "Platform").
Please read these Terms carefully. By accessing, browsing, registering on or using the Platform in any way, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Platform.
These Terms, together with our Privacy Policy, Refund & Cancellation Policy, Disclaimer and any additional terms shown at the point of a specific service, form the complete agreement between you and us. This document is also our "rules and regulations" and "user agreement" published in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
1. What househelp is — and what it is not
househelp is an online introduction and facilitation platform. We connect households in Delhi NCR (including Gurgaon, Delhi and Noida) who are looking for domestic help — such as cooks, house cleaners, nannies/babysitters, drivers and elder-care attendants — with individuals ("Workers") who are looking for and willing to do such household work and who tell us they already know the basic tasks involved.
Please read this section carefully, because it defines the limits of what we do.
a. We are a facilitator / intermediary, not an employer. We provide access to Worker profiles and help arrange an introduction and, where you wish, an interview between you and a Worker. We are an intermediary and facilitator only. We do not employ the Workers, we do not engage them, and we do not supply labour. No employment, agency, partnership or master-servant relationship is created:
- between househelp and any Worker; or
- between househelp and any Household; or
- between any Household and househelp in respect of a Worker.
Any working arrangement or engagement is entered into directly and solely between you (the Household) and the Worker. You are the employer or principal of any Worker you engage, and you alone are responsible for the terms of that engagement and for complying with all laws that apply to it.
b. We do not guarantee, vet or vouch for Workers. househelp does not promise, guarantee or represent the quality, honesty, character, conduct, skill, health, background, antecedents or suitability of any Worker. We do not represent that Workers are "pre-vetted", "verified", "trusted" or of any particular standard, and we make no assurance that any Worker is a "good" worker. What we offer is access to people who are looking for household work, are willing to do it, and state that they know the basic tasks — nothing more.
c. You must interview and use your own judgement. Deciding whom to interview, whom to trust and whom to hire is entirely your decision and your responsibility. You are expected to interview the Worker yourself, ask your own questions, check references and documents, exercise your own independent judgement, and satisfy yourself about the Worker before you engage them or allow them into your home. househelp facilitates the introduction and the interview; househelp does not make the hiring decision and is not responsible for it.
d. Optional add-ons are not a guarantee. We may offer optional, paid add-on services (for example, assistance in arranging police verification). These are not provided by default, are entirely optional, and are not a warranty or guarantee by househelp of any Worker's background, conduct or suitability. Any such service is provided on a reasonable-effort basis and, where carried out by a third party (such as the police or a verification agency), is subject to that third party's own process, accuracy and timelines, for which househelp is not responsible. See our Disclaimer for more.
2. Definitions
- "Platform" — the househelp website, and any associated pages, tools and services.
- "Household" / "Employer" / "you" — a person or family using the Platform to find domestic help.
- "Worker" — an individual whose profile is onboarded and listed on the Platform as looking for household work.
- "Introduction" — our act of connecting a Household with a Worker and helping arrange an interview.
- "Placement Facilitation Fee" — the one-time fee described in Section 6.
- "HelpCare Plus" — the optional monthly support subscription described in Section 6.
- "Content" — any information, text, messages, profile details, booking details or other material submitted to, or made available through, the Platform.
3. Eligibility
To use the Platform and accept these Terms you must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. The Platform is not intended for minors, and a contract with a minor is void. If you are using the Platform on behalf of a household, family or organisation, you confirm that you are authorised to bind them to these Terms. You must provide accurate information about yourself. Use of the Platform is void where prohibited by law.
4. Your account, mobile number and OTP
- To use certain features you may need to register using your full name, mobile number, email address and city.
- You agree that the information you provide is true, accurate, current and complete, and you will keep it updated.
- We may verify your identity or contact details using a One-Time Password (OTP) sent to your mobile number or email. You are responsible for keeping your OTP, login details and device secure. Do not share your OTP with anyone, including anyone claiming to be from househelp — we will never ask you for your OTP to authorise a payment.
- You are responsible for all activity that takes place through your account or verified number. Notify us immediately at [SUPPORT EMAIL] if you suspect unauthorised use.
- We may refuse, suspend or cancel registration, or require re-verification, at our reasonable discretion, including to protect the Platform or other users.
Your personal data is handled in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023. Accepting these Terms is not your consent to the processing of your personal data — that consent is taken separately, as explained in the Privacy Policy.
5. How the introduction works
- You browse or request Worker profiles for the type of help you need.
- We facilitate an Introduction and help arrange an interview between you and the Worker.
- You interview the Worker and decide, using your own judgement, whether to engage them.
- If you choose to hire a Worker, a Placement Facilitation Fee becomes payable to househelp (see Section 6).
- Any salary, wages, leave, working hours, duties, accommodation and other terms are agreed directly between you and the Worker, and salary is paid by you directly to the Worker. househelp is not a party to, and does not collect or hold, the Worker's salary.
We do not control whether a Worker attends an interview, accepts an engagement, performs well, stays on the job, or behaves in any particular way. Introductions are made on an "as-available" basis and we do not guarantee that a suitable Worker will be found for you.
6. Fees, payments and taxes
a. Placement Facilitation Fee. If — and only if — you hire a Worker introduced through the Platform, you agree to pay househelp a one-time Placement Facilitation Fee equal to 15% of the Worker's agreed first month's salary. This fee is for our facilitation and introduction service. It is not a salary, not a deposit against the Worker's conduct, and not a fee that househelp pays to the Worker.
b. Optional add-ons. You may separately choose optional paid add-on services (such as assistance in arranging police verification, or an interstate compliance pack). These are charged at the prices shown at the time you opt in and are subject to Section 1(d).
c. HelpCare Plus (optional). We may offer HelpCare Plus, an optional monthly support subscription providing ongoing assistance (for example, help arranging a replacement introduction). HelpCare Plus is entirely optional, is billed monthly at the price shown, and you may cancel it at any time in the manner described at sign-up or by contacting us; cancellation stops future billing. See our Refund & Cancellation Policy for details.
d. Salary is paid directly to the Worker. househelp does not receive, hold or disburse any Worker's salary or wages. All salary is your responsibility and is paid by you directly to the Worker.
e. Taxes. Our fees are subject to Goods and Services Tax (GST) and any other applicable taxes, which will be shown and charged as required by law. We will issue a tax invoice for amounts you pay to us. Unless stated otherwise, prices are shown inclusive of applicable GST.
f. Explicit consent, no hidden charges. We will not charge you automatically or on the basis of a pre-ticked box. A fee becomes payable only through your explicit, affirmative action (such as confirming a hire or opting into a service). We do not impose unfair or hidden charges.
7. Cancellations and refunds
- You may cancel a service request before a Worker has been hired, without charge.
- We will not impose cancellation charges on you after a confirmation unless we would bear equivalent charges on our own cancellation, in line with the Consumer Protection (E-Commerce) Rules, 2020.
- Where a refund is due (for example, a duplicate payment, a service we could not provide, or as required by law or our published policy), we will process it within a reasonable period to the original payment method, in accordance with Reserve Bank of India norms.
- Because the Placement Facilitation Fee is charged for a completed introduction and hire, it is generally non-refundable once the introduction and facilitation service has been fully delivered, except as required by law or expressly stated in a specific offer (such as a replacement commitment).
Full details, including replacement windows and add-on/subscription refunds, are set out in our Refund & Cancellation Policy, which forms part of these Terms.
8. Your obligations and undertakings
You agree that you will:
- provide true, accurate and complete information, and not impersonate any person or misrepresent your identity;
- use the Platform only for lawful purposes and for genuinely seeking household help for your own household;
- interview and satisfy yourself about any Worker before engaging them, and make your own hiring decision;
- treat Workers lawfully, fairly and with dignity, and comply with all applicable laws in any engagement you enter into, including laws on minimum wages, working conditions, non-discrimination, and the prohibition of child, forced or bonded labour;
- pay any agreed fee to househelp and any agreed salary to the Worker on time;
- not attempt to bypass the Platform to avoid the Placement Facilitation Fee after being introduced to a Worker through the Platform;
- keep confidential any personal information you receive about a Worker and use it only to decide on and manage an engagement, in accordance with applicable data-protection law;
- not use the Platform to harass, exploit, defraud or endanger any Worker or other person.
9. Prohibited conduct and content
You must not use the Platform to host, display, upload, modify, publish, transmit, store, update, share or otherwise make available any information or Content that:
- belongs to another person and to which you do not have any right;
- is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or otherwise unlawful;
- is harmful to a child;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads about its origin, or impersonates another person;
- is patently false or untrue and is shared with intent to mislead, harass or cause injury, or for financial gain;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or incites any cognisable offence;
- contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
- violates any law for the time being in force.
You also must not: scrape, harvest or copy Worker data or profiles; use bots or automated means to access the Platform; attempt to gain unauthorised access to the Platform or other users' accounts; interfere with the Platform's operation or security; or use the Platform to send spam or unsolicited communications.
We may remove any Content, and suspend or terminate access, where we reasonably believe there is a breach of this Section or of the law, and we will act on valid legal, court or government orders as required under the Information Technology Act, 2000 and the rules made under it. To report objectionable Content, see our Contact & Grievance Redressal page.
10. Worker profiles and third-party content
Worker profiles and other Content are based largely on information provided by, or about, the Workers and other users. We onboard Worker profiles and ask Workers to confirm that the information they give is accurate, but we do not independently verify, and cannot guarantee the accuracy, completeness or truth of, any profile, statement, document, skill claim or background information. You should verify all such information yourself during your interview and selection process (see Section 1).
As an intermediary under Section 79 of the Information Technology Act, 2000, we are not responsible for third-party Content made available through the Platform, and we do not endorse any Worker or user.
11. Intellectual property
The Platform, and all software, text, graphics, logos, layout, design, the "househelp" name and brand, and other material we provide (excluding user- and Worker-submitted Content), are owned by or licensed to househelp and are protected by Indian and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended personal, non-commercial purpose of finding household help, subject to these Terms.
You must not copy, reproduce, modify, distribute, sell, licence, reverse-engineer or create derivative works from any part of the Platform without our prior written consent. By submitting Content, you grant househelp a non-exclusive, royalty-free licence to use, host and display that Content to the extent needed to operate and provide the Platform.
12. Privacy and data protection
Our collection and use of personal data is described in our Privacy Policy, which you should read. We handle personal data in accordance with the Digital Personal Data Protection Act, 2023 and applicable rules. Your consent to the processing of your personal data is obtained separately and is not bundled into these Terms.
13. Third-party links and services
The Platform may contain links to, or integrate, third-party websites or services (for example, payment gateways or verification agencies). We are not responsible for the content, policies or practices of any third party, and your use of a third-party service is governed by that third party's own terms.
14. Disclaimers
To the maximum extent permitted by law, and without limiting Section 1:
- the Platform and Introductions are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied;
- we do not warrant the quality, character, honesty, skill, conduct, background, health or suitability of any Worker, nor the accuracy of any profile or Content;
- we do not warrant that a suitable Worker will be found, that any Worker will attend, accept, perform or continue an engagement, or that the Platform will be uninterrupted, secure or error-free;
- you remain solely responsible for interviewing, selecting, engaging, supervising and managing any Worker, and for anything a Worker does or fails to do.
Nothing in this Section limits any right you have as a consumer that cannot be excluded under Indian law. Our full Disclaimer page sets this out in more detail.
15. Limitation of liability
To the maximum extent permitted by applicable law:
- househelp, its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of data, opportunity, reputation or goodwill;
- househelp will not be liable for the acts, omissions, conduct, negligence, misconduct, dishonesty, theft, injury or default of any Worker or user, or for any loss or damage arising out of any engagement between a Household and a Worker, this being a matter between them;
- our total aggregate liability to you for any claim arising out of or relating to the Platform or these Terms will not exceed the total amount of fees you actually paid to househelp for the specific service giving rise to the claim in the three (3) months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our own negligence, for our own fraud or gross negligence, for deficiency in the service we are actually paid to provide, or any rights you have as a consumer under the Consumer Protection Act, 2019. Any term that would be an unfair contract term under law will, to that extent, not apply to you.
16. Indemnity
You agree to indemnify and hold harmless househelp and its directors, employees and agents from any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of: your breach of these Terms or of any law; your engagement of, or dealings with, any Worker; any Content you submit; or your misuse of the Platform. This clause does not require you to indemnify us for our own fraud, gross negligence or breach, and does not affect your rights as a consumer.
17. Suspension and termination
You may stop using the Platform at any time and may ask us to close your account. We may suspend or terminate your access, with notice where reasonably practicable, if you breach these Terms or the law, misuse the Platform, or where required to protect the Platform, its users or Workers. Sections that by their nature should survive termination (including Sections 1, 6, 8, 9, 11, 14, 15, 16 and 19) will continue to apply.
18. Grievance redressal and compliance contacts
If you have a complaint or grievance about the Platform, any Content, a payment, or a possible violation of these Terms or of the Information Technology Act, 2000 and the rules made under it, you may contact our Grievance Officer:
- Grievance Officer: [GRIEVANCE OFFICER NAME], [GRIEVANCE OFFICER DESIGNATION]
- Email: [GRIEVANCE EMAIL]
- Phone: [PHONE]
- Address: [REGISTERED ADDRESS]
Timelines. For content and other matters under the IT Rules, our Grievance Officer will acknowledge your complaint within 24 hours and endeavour to resolve it within 15 days. For consumer grievances under the Consumer Protection (E-Commerce) Rules, 2020, we will acknowledge within 48 hours and redress the complaint within one month of receipt. Where more than one timeline applies, we apply the stricter one. Full disclosures, the Nodal Officer's details and the complete complaint process are on our Contact & Grievance Redressal page.
19. Governing law, jurisdiction and dispute resolution
a. Governing law. These Terms are governed by, and construed in accordance with, the laws of India.
b. Amicable resolution. In the event of any dispute, the parties will first attempt to resolve it amicably by writing to our Grievance Officer.
c. Arbitration. If a dispute is not resolved within thirty (30) days, it may be referred to and finally resolved by arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be [CITY], [STATE], India, and the arbitration will be conducted in English. This arbitration clause is separable and survives termination of these Terms.
d. Jurisdiction. Subject to the arbitration clause above, the courts at [CITY], [STATE], India will have exclusive jurisdiction over any dispute arising out of these Terms.
e. Your rights as a consumer are preserved. Nothing in this Section takes away any right you have as a consumer under the Consumer Protection Act, 2019, including your right to approach the appropriate Consumer Disputes Redressal Commission, and (where the law so provides) to do so from the place where you reside or work. Consumer disputes are not compelled into arbitration against your will.
20. Changes to these Terms
We may update these Terms from time to time to reflect changes in our services or the law. When we do, we will post the updated Terms on the Platform and change the "Last updated" date. Material changes will be notified to you where required. Your continued use of the Platform after an update means you accept the revised Terms.
21. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, civil unrest, strikes, government action, power or internet failures, or failures of third-party services.
22. General
- Severability. If any provision of these Terms is held invalid or unenforceable, the rest remains in full force, and the invalid provision will be applied to the maximum extent permitted by law.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign your rights under these Terms without our consent; we may assign ours to an affiliate or successor.
- Entire agreement. These Terms, with the Privacy Policy, Refund & Cancellation Policy, Disclaimer and any service-specific terms, are the entire agreement between you and us regarding the Platform.
- Notices. Notices to us should be sent to [SUPPORT EMAIL]; notices to you may be sent to the contact details in your account.
